1. Purpose

These General Terms and Conditions of Use and Sale ("T&Cs") govern access to and use of the Marhba Box Serenity Site, as well as the terms of sale for our digital products (travel guides, themed itineraries, welcome kits, and associated downloadable content).

Any order placed on the Site implies full and unreserved acceptance of these T&Cs.

2. Acceptance of T&Cs

By placing an order on the Site, the user acknowledges having read and unreservedly accepted these T&Cs. The T&Cs are accessible at all times on the Site and can be downloaded or printed by the user.

The user declares to have the legal capacity to contract (legal majority or parental authorization if applicable).

3. Products Offered

Our kits are digital products and connectivity services, including, depending on the chosen package: an eSIM (or, if incompatible, a physical SIM card provided upon arrival in Marrakech, subject to prior logistical agreement), a digital tourist guide, practical information, an interactive map of must-sees, recommended itineraries, access to local partner benefits, and WhatsApp assistance depending on the package.

Digital content (guide, map, partner access) is delivered by email after payment validation. The eSIM or connection profile is sent by email or WhatsApp within an average of 1 to 2 hours after purchase. A physical SIM card can be handed over in Marrakech if the customer's phone is incompatible with eSIM technology.


4. Order, Price and Payment

Prices are indicated in euros (€) (Discovery kit: €9.90, Comfort kit: €19.90, Serenity kit: €29.90, and Group and Family kit: €34.90), all taxes included if applicable. The amount displayed in euros at the time of order validation is binding.

Payment methods: Orders are paid by credit card or via a personal PayPal account through the secure payment gateway provided by PayPal Pte. Ltd., a company registered in Singapore (under registration number 200509725E), whose registered office is located at 5 Temasek Boulevard, #09-01 Suntec Tower Five, Singapore 038985.

Security and processing: All financial transactions are processed directly by PayPal Pte. Ltd.'s secure servers. The Site Editor (MARHBA Box Serenity) does not collect, store, or process any banking or sensitive data related to your payment method.

Data transfer outside Morocco: By choosing this payment method, the Buyer expressly consents to the data strictly necessary for the validation and security of the transaction (name, first name, email address, transaction amount, and order details) being transferred, processed, and stored by PayPal Pte. Ltd. in Singapore.

This cross-border data transfer is necessary for the execution of your order and is carried out in accordance with Moroccan law no. 09-08 relating to the protection of personal data, for which an authorization request for international transfer has been submitted to the CNDP (National Commission for the Control of Personal Data Protection).

5. Product Access

After payment validation, the user receives all elements of their kit by email and/or WhatsApp: access to the digital guide and interactive map, practical information, and, if applicable, the eSIM profile or instructions for retrieving the physical SIM card.

- The link to access digital content is personal and non-transferable.
- It remains valid for 30 days from its dispatch and allows for a maximum of 3 downloads.
- In case of access problems (expired link, corrupted file, email not received, eSIM not received), the user can contact marhba.box.serenity@gmail.com or WhatsApp Business; a new transmission will be made free of charge after purchase verification.

6. Right of Withdrawal

In accordance with article L221-28 of the Consumer Code (French law, applicable by reference for our customers residing in the European Union) and equivalent provisions in Moroccan law, the right of withdrawal does not apply to digital content not supplied on a tangible medium, the execution of which has begun after the consumer's express prior agreement and express waiver of their right of withdrawal.

Consequently, before any payment validation, the user is invited to check a box confirming:

  1. that they request immediate execution of the service (access to digital content);
  2. that they expressly waive their right of withdrawal from the beginning of the download.

In the absence of this explicit confirmation at the time of order, the legal 14-day right of withdrawal may apply for customers residing in the EU.

7. Intellectual Property

All content offered in our kits and guides (texts, layouts, illustrations, guides, itineraries) is the exclusive property of Marhba Box Serenity, protected by Moroccan copyright law and applicable international conventions.

Any reproduction, distribution, resale, modification, or making available of all or part of this content, without prior written authorization, is strictly prohibited and may lead to prosecution.

Our documents may contain tracking devices (watermark, unique identifier) allowing the identification of the origin of unauthorized distribution. In the event of fraudulent use, the user may be contacted for immediate cessation, without prejudice to other possible remedies.

8. Personal Data Protection

Personal data collected (name, email, order information) is processed in accordance with our Privacy Policy, available on the Site, in compliance with Moroccan law no. 09-08 relating to the protection of personal data and, for our customers residing in the European Union, with the General Data Protection Regulation (GDPR).

Processing by Shopify:

To ensure the technical operation of our online store, the management of your orders, and payment processing, your personal data is transmitted to our technical service provider Shopify Inc., whose headquarters are located at 151 O'Connor Street, Ground Floor, Ottawa, ON K2P 2L8, Canada. Data may be processed and stored on secure servers located in Canada, the United States, and Europe. This transfer is governed by strict security guarantees in accordance with Shopify's general data processing terms (Data Processing Addendum).

Data Transfer – Advertising Optimization and Statistics:
Our site uses professional tools from Meta Platforms Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland), including the Meta Pixel, to analyze site audience and optimize our advertising campaigns. Certain browsing data (pages visited, items added to cart) is transmitted to them. Meta processes this data in accordance with its Data Policy. Data transfers outside the European Economic Area are governed by Meta's Standard Contractual Clauses.

Data Processing (PayPal): To secure your transactions, your order data (name, email, and amount) is shared with our payment provider PayPal Pte. Ltd. based in Singapore. Your banking details are processed 100% encrypted and secured by PayPal, without us having access to them. .

**CNDP Compliance:**
In accordance with Law No. 09-08, a processing declaration has been submitted to the National Commission for the Control of Personal Data Protection (CNDP). 9. Liability

Marhba Box Serenity undertakes to provide carefully verified and updated content. However:

  • Our guides and itineraries are provided for informational purposes only and do not in any way replace medical, professional advice or an official consultation (especially regarding health, safety, or local regulations).
  • Marhba Box Serenity cannot be held responsible for the consequences of improper use of its products, nor for developments subsequent to publication (schedules, prices, availability of third-party service providers mentioned).
  • This limitation of liability does not apply in cases of gross negligence or intentional fault on our part, in accordance with applicable mandatory consumer protection provisions.
  • The addresses, prices, and schedules mentioned in this kit are purely indicative and based on local data at the time of publication. Marhba Box cannot be held responsible for changes in prices or closures of third-party establishments.

10. Force Majeure

Marhba Box Serenity cannot be held responsible for any delay or non-performance resulting from a case of force majeure (widespread technical breakdown, natural disaster, or any event beyond its reasonable control).

11. Modification of the GTC

Marhba Box Serenity reserves the right to modify these GTC at any time. The applicable version is the one in force at the time of the order. Users are invited to consult this page regularly.

12. Applicable law and dispute resolution

These GTC are subject to Moroccan law, as Marhba Box Serenity is a company registered in Morocco.

In case of a dispute, the user is invited to contact Marhba Box Serenity primarily via email at marhba.box.serenity@gmail.com to seek an amicable solution.

Failing an amicable resolution, any dispute falls in principle within the jurisdiction of the courts of Marrakech (Palais de Justice, Av Tassiltante, Sidi Youssef Ben Ali).

For customers residing in the European Union: this clause does not deprive the consumer of the mandatory rights provided by the law of their country of residence when it is more favorable to them, nor of the possibility, under the conditions provided by Regulation (EU) No 1215/2012 ("Brussels I recast"), to bring proceedings before the courts of their own place of residence when the seller is considered to be directing its activities to that State (the site being offered in several European languages and explicitly targeting European tourist customers).

Note: the European online dispute resolution (ODR) platform was definitively closed on July 20, 2025, and should no longer be referenced on the Website.


13. Language and severability

These GTC are written in French. In case of translation into another language, the French version shall prevail in case of a divergence of interpretation.

If any of the clauses of these GTC were declared null or unenforceable, the other clauses would retain their full validity.
